Tribunal upholds Abbas’ election, dismisses Nyako’s petition 

The National Assembly election petition tribunal sitting in Yola, Adamawa state, capital, presided over by Justice Maryam Sabo, has exonerated the Senetor representing Adamawa Central, Senator Aminu Iya Abbas, from forgery allegations levelled against him by the APC candidate, Senator Abdulaziz Murtala Nyako of the APC.

Just as the tribunal have equally awarded a cost of N750,000 against Nyako and in favour of Senator Abbass of the PDP whose election was upheld by the tribunal as the Senator representing Adamawa South senatorial district.

This judgement by the tribunal followed the pertition filed against Abbas victory by the APC candidate in the election Senator Abdulaziz Murtala Nyako seeking for nullification of Abbas’ victory and his declaration as the authentic winner of that election over what he called falsifications of documents  submitted to INEC by the Senator.

In her judgement delivered Monday, the chairperson of the tribunal, Justice Sabo dismissed the petition in its entirety for lacking in merit and upheld the the victory of Abbas as the senator representing Adamawa Central senatorlal district in the National Assembly.

Justice Sabo said that the petitioner failed woefully to prove his allegations beyond all reasonable doubt, stressing that “there is no credible evidence presented by the pertitioner to the tribunal to warrant the nullification of the election.”

She further explained that the onus of proof lied on the petitioner but the documents submitted by the petitioner failed short of expectations and did not prove any criminal intent on the part of the Senator.
